Thistle & Wild Design Terms & Conditions


What these terms cover
. These are the terms and conditions on which Thistle & Wild Design supply services to the client, including goods where relevant.

Why you should read them:

Please read these terms and conditions carefully before you sign. 

These terms tell the client how Thistle & Wild Design will provide services or goods to the client, how the client and Thistle & Wild Design may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact Rebecca at thistleandwild@gmail.com to discuss.

1. Thistle & Wild Design’s contract with you

How Thistle & Wild Design will accept your request for a Consultation. Thistle & Wild Design will reply to your enquiry by email to arrange a consultation. The consultation fee is payable in advance.

If Thistle & Wild Design is unable to accept your request for a Consultation or request for Further Design Work following the consultation: You will be informed by email if Thistle & Wild Design is unable to accept your request due to a) consultation availability is fully booked b) unexpected limits on Thistle & Wild Design’s availability b) it is not feasible to meet a deadline you have specified c) Thistle & Wild Design does not consider itself a fit for your project. 

2. Services

Consultation. The consultation is key to the success of your project to ensure your aspirations, requirements, level of service required is ascertained. Please ensure all decision makers are available to attend and take part in the consultation.

Design Brief, Scope of Work and Fee proposal: Following the consultation, a design brief, scope of work and fee proposal will be prepared and emailed to the client with the terms and conditions of service for consideration.

If the client wishes to approve the design brief, scope of work, fee proposal and terms and conditions, please sign the document and return to Thistle & Wild Design by email before work commences. 

Design work shall be carried out in accordance with the agreed design brief, scope of works and an agreed timescale.

3. Fees

After the initial consultation, Thistle & Wild Design shall provide the client with a written fee proposal for carrying out the services set out in the scope of works. This quotation will be valid for one month from its date. Any changes and additions to agreed to the design brief may result in a change to the fee proposal. If the client wishes to go ahead and the design brief and the fee proposal are agreed, an invoice will be issued for an agreed amount set out in the fee proposal. 

Please note that fees for additional services will be chargeable if you ask Thistle & Wild Design to design / deliver / advise on works beyond the agreed design brief.

Thistle & Wild Design is not VAT registered. 

4. Payments. Thistle & Wild Design only accept payment directly into the business bank account, bank details are included on each invoice.

Please make scheduled payments in accordance with the payment schedule set out in the fee proposal and on receipt of an issued invoice. Please pay each invoice within seven calendar days after the date of the invoice. All work shall pause if payment has not been received within seven calendar days. Thistle & Wild Design will contact the client to tell them that supply of services will cease until payment is received. 

5. What to do if you think an invoice is wrong. If you think an invoice is wrong please contact Rebecca by email thistleandwild@gmail.com promptly.

6. Additional services. If more revisions to a design are requested by the client than has been agreed in the design brief or are reasonable, an hourly additional fee will be charged. The client will be notified prior to this so a decision can be made whether they wish an additional revision to the design to take place. 

If further projects or specific services are needed by the client in addition to the work set out in the scope of works a separate fee proposal or agreed hourly rate and design brief will be required.

7. What Thistle & Wild Design require from the client. Unless otherwise agreed, Thistle & Wild Design will require the following from the client to deliver the services offered:

      1. Sufficient information to prepare the design brief. This information will be obtained during the design consultation.

      2. If the client is working with an architect, provide Thistle & Wild Design with electronic scaled architectural plans and elevations (scale 1:50 or 1:100) for the project.

      3. If the client is not working with an architect and has booked an in person consultation, Thistle & Wild Design will obtain the necessary dimensions during the consultation or a per-arranged site survey.

      4. If the client is not working with an architect and has booked an online consultation, the client is responsible for providing Thistle & Wild Design with floor plans and dimensions prior to the online consultation.

      5. Thistle & Wild Design may take photos during an in person consultation or during a per-arranged site survey.

      6. Client to provide images for discussion during the consultation that are relevant and inspire them and will inform and guide the design process. These can be in the client’s preferred format. For example: magazine pages, brochures, photographs, colour or material swatches or samples, pinterest, instagram.

      7. Photos and dimensions of any existing items to be incorporated in the scheme to be provided by the client.


8. Plans and measurements. In regard to clause 7.2. and 7.4 Thistle & Wild Design will design to the specification, plans and measurements that have been provided. The client is responsible for ensuring that these plans and measurements are correct.

9. Client’s other responsibilities. The client is required to ensure that their home is safe during consultation and site visits.

10. Thistle & Wild Design standards.  Thistle & Wild Design provide services using reasonable care and skill and in compliance with the commonly accepted practices and standards of an interior design studio. Whilst it is the hope that the outcome of the services will give you pleasure for many years to come, no interior design studio can guarantee this and you acknowledge that:

  1. All decisions are yours, even if they are recommended by Thistle & Wild Design;

Thistle & Wild Design services are conceptual only and should be verified with relevant third party suppliers engaged by you to implement the design if required. 

11. Third Parties. Thistle & Wild Design will not liaise with third party suppliers or trades or architect engaged by the client unless agreed in advance.

Thistle & Wild Design will have no liability for any dissatisfaction the client may experience because of the way in which the design is implemented by the third party suppliers; and

Conceptual drawings and designs produced by Thistle & Wild Design which require structural and / or building work will not be suitable or fit for construction purposes (including planning or building regulation consent). The client will need to submit drawings and designs to relevant third parties (e.g. architects, structural engineers, builders, local council) for technical interpretation and verification and who will be responsible for the review of all applicable laws, regulations, permissions and compatibility.

12. Recommended third party suppliers and trades. Where Thistle & Wild Design recommend third party suppliers or trades for the client’s project, Thistle & Wild Design may provide you with links to access such suppliers’ websites or other contact details or share prepared orders for you to be able to correspond with or purchase products or direct Thistle & Wild Design to make a purchase or place an order on the client’s behalf or arrange services from a third party. If the client decides to purchase any products or services or direct Thistle and Wild Design to do so, the client does so solely at their own risk. Thistle & Wild Design cannot make any representation or commitment, and accordingly cannot be liable for any third party products or services or the client’s use of them, or their correspondence with any such third party suppliers or trades or any transactions completed, or any contract entered into, by the client with any such third party suppliers or trades.

Any contract entered into and any transaction completed with any third party is between the client and the relevant third party and not Thistle & Wild Design.

13. Provision of services If you are purchasing services Thistle & Wild Design will begin preparation for your design consultation on receipt of payment.

Thistle & Wild Design are not responsible or liable for delays outside our control. If our supply of services or the goods ordered are delayed by an event outside our control then Thistle & Wild Design will contact you as soon as possible to let you know. 

If the client is not at home when goods are delivered. If no one is available at your address to take delivery and the goods cannot be posted through your letterbox, it is the client’s responsibility to reorganise delivery and to cover any cost that they may incur. 

If you do not re-arrange delivery or collect items from a delivery depot the client will be liable for any costs incurred.

When you become responsible for the goods. Goods will be your responsibility from the time they are delivered to the address you provided.

If you do not allow Thistle & Wild Design access to provide services. If it is agreed at the design brief stage that access is required to your property to perform the services, and if you do not allow us such access as pre-arranged (and you do not have a good reason for this) additional charges to cover lost time will be charged. 

What will happen if the client does not provide the required information. Thistle and Wild Design will not be responsible for supplying the services or goods late or not supplying any part of them if this is caused by the client not providing the information needed within a reasonable time of Thistle and Wild Design asking for it.

14. The client’s rights to end the contract:

The client can end their contract with Thistle and Wild Design. The client’s rights when they end the contract will depend on what services they have bought, how Thistle & Wild are performing and when you decide to end the contract:

Deductions from refunds if you are exercising your right to change your mind and how long does the client have to change their mind? 

If you would like to cancel or reschedule your Consultation:
To receive a full refund or the option to rebook you must notify Thistle & Wild Design by email at least two days notice before your booked consultation.
You will be offered a 50% refund if one day of notice is given.
No refund shall be offered if less than 12 hours notice is given.
If a rescheduled consultation is cancelled, no refunds will be given and a new date shall not be offered or accepted.

Design services: The client has 7 days from the day the fee proposal and design brief is accepted to cancel. However, where Thistle & Wild Design are providing services, Thistle & Wild Design will deduct from any refund the amount for the supply of services for the period for which it was supplied, ending with the time when the client told Thistle & Wild Design they had changed their mind. The amount will be in proportion to what has been supplied, in comparison with the full coverage of the contract.

If the work has been completed in full, no refund shall be given even if it falls within the 7 day cooling off period.

15. How to end the contract with Thistle and Wild Design: To end the contract, please email thistleandwild@gmail.com
Please provide your name, home address, details of the request and reason for cancellation.

How Thistle and Wild Design will refund you. If a refund is due, please provide your bank details and an agreed amount shall be refunded within 7 days.

16. Thistle & Wild Design has the right to end the contract

Thistle and Wild Design will end the contract with immediate effect and without notice if :

16.1 A client uses language or tone in person, or in any form of communication which Thistle and Wild Design or others find rude, causes offense, is disrespectful, aggressive, argumentative, abusive, threatening or demanding.

16.2 A client makes Thistle & Wild Design or any person involved in the design or delivery of the project feel uncomfortable in any way.

16.3 A client demonstrates behaviour or an attitude which Thistle & Wild or others deem unacceptable.

16.4 A client does not make a payment when it is due and does not do so within calendar 7 days of when the payment is due.

16.5 A client does not, within a reasonable time of being asked for it, provide Thistle & Wild Design with information that is necessary to provide the services or goods, for example, dimensions, plans as agreed in the scope of work, etc.

16.6 A client does not, within a reasonable time, allow the delivery of goods.

16.7 A client does not, within a reasonable time, allow Thistle & Wild Design access to the premises to supply the services as agreed in the scope of work.

17. If Thistle & Wild Design plan to withdraw services due to any of the above clauses in section 16. Thistle & Wild Design will notify the client by email that the supply of the services has ceased. 

Thistle & Wild Design will refund sums the client has paid in advance for goods or services which have yet commenced. Thistle & Wild Design may deduct or charge reasonable compensation for loss of earnings incurred as a result of a break in contract.

18. Your obligation to return rejected goods. If you wish to exercise your legal rights to reject goods you must either return them in person to where you bought them, post them back to the supplier or arrange for a courier collection. The client is responsible for the cost of return postage or collection. It is the client’s responsibility to return items within the supplier’s return time-frame.

19. Samples The majority of samples are free of charge to Interior Design professionals. If there is a charge for samples and / or the postage, the cost shall be added to the client’s invoice.

20. Social Media and Website : By accepting these terms and conditions, the client gives permission for elements of the project, design, project progress, installation and completion to be photographed, documented and shared on Thistle & Wild Design website and social media platforms. The client’s names and project address will remain anonymous.

21. Studio Hours : Thistle & Wild Design Studio core hours are 10am - 3pm. The studio is closed every weekend and for 6 consecutive weeks from late July to early September, between Christmas and New Year and a child care break in April. Rebecca’s availability can be shared prior to signing this agreement if requested.

22. Communication : Contact is kept to email, in person meetings and pre-arranged online meetings strictly between 10am and 3pm.
